What Thuto360 provides, what each school can expect from us, and what we expect in return.
1. Who these terms are between
These terms are an agreement between Thuto360 ("we", "us") and the school, tuition centre or other organisation that signs up ("the school"). The person who signs up confirms that they may agree to them on the school's behalf.
Everyone the school gives an account to — staff, parents, guardians and students — uses Thuto360 through the school. The school is responsible for who it lets in and for what they do there.
2. What we provide
Thuto360 is an online system for running a school: student records, branches, fees and payments, attendance, marks and report cards, staff and leave, and a portal for parents. We host it, keep it running, back it up and improve it.
We aim to keep Thuto360 available at all times, but we cannot promise it will never be interrupted. We will try to give notice of planned maintenance and to fix unplanned problems quickly.
3. Plans, prices and payment
- Each plan has a monthly price in pula and limits on enrolled students, branches and the designs it includes. The current plans are on our front page.
- The Free plan costs nothing.
- Each school may try one paid plan free for 30 days, once only. Nothing is charged during it and no card is needed. When it ends the school returns to the plan it was on unless it subscribes; students added beyond that plan's limit are locked (kept, but unusable) until the school upgrades, and the school's design returns to one its plan includes. A school that has had its free trial cannot have another, of any plan.
- Paid plans are paid monthly or termly, in advance, by bank transfer or mobile money.
- We may change our prices. We will tell the school at least 30 days before a change affects what it pays.
- If a payment is overdue we will tell the school, and after reasonable notice we may suspend its access until it is paid. Suspending does not delete anything.
4. The school's data
Everything the school puts into Thuto360 — about its students, families, staff and finances — belongs to the school. We use it only to provide Thuto360 to the school, as described in our privacy policy, and never sell it or use it to advertise to anyone.
The school can download all of its data at any time, on any plan, from Settings → Export data.
The school is responsible for having the right to collect the personal information it puts into Thuto360, for telling the people concerned (including parents, about their children) how it is used, and for keeping it accurate.
5. Fair use
The school and its users must not:
- use Thuto360 for anything unlawful, or to store information the school has no right to hold;
- try to reach another school's data, test or break our security, or overload the service;
- share accounts or passwords, or let anyone use an account that is not theirs;
- copy, resell or reverse-engineer Thuto360.
6. Accounts and security
Each user must keep their password to themselves. The school should remove accounts for people who leave, and tell us straight away if it thinks an account has been misused.
We protect the service with measures appropriate to the information in it, including keeping every school's records walled off from every other school's. If we learn of a breach that affects the school's data we will tell the school without undue delay.
7. Ending the agreement
- A school on the Free plan that nobody has signed in to for 90 days is closed, and the school and all its data are permanently deleted.
- A paid plan that has run out and is not renewed within 90 days is closed the same way: the school and all its data are permanently deleted.
- The school may stop using Thuto360 at any time. Export your data first.
- We may close a school's account if it seriously or repeatedly breaks these terms, after telling it why where we reasonably can.
- When a school closes its own account, we keep its data for 90 days so it can still be exported, and then delete it, except where the law requires us to keep something longer. Backups age out on their normal cycle.
8. Responsibility
We provide Thuto360 with reasonable care and skill. Beyond that, and as far as the law allows, we are not responsible for indirect losses such as lost profits, and our total responsibility to the school in any year is limited to what the school paid us in that year.
Nothing in these terms limits a responsibility that the law does not allow to be limited.
9. The Revision Bank, learner and parent accounts
- The Revision Bank is free practice for anyone. Visitors may practise without an account; learners and parents with no school may make a free account, and agree to these terms when they do. Learners under 18 need a parent or guardian to confirm their account.
- Questions are for revision. Thuto360's mock papers are written in the style of national examinations and are not official papers. The learner's licence questions come from the Department of Road Transport and Safety's catalogue; the official test is what counts.
- Certificates the Revision Bank issues (for example "licence ready") are encouragement, not qualifications.
- Learner Plus is optional and paid monthly by arrangement with us. Free accounts may sit a set number of timed papers a week; Plus removes that limit and the adverts. We may change its price with 30 days' notice to members.
- Teachers may set their own questions and tests for their school. Anything a school marks public is checked by Thuto360 before others see it, and the school confirms it has the right to share it.
10. Changes and the law
We may update these terms. If a change matters, we will tell the school before it takes effect. Continuing to use Thuto360 after that means the school accepts the new terms.
These terms are governed by the laws of Botswana, and the courts of Botswana decide any dispute about them.
